Speak Asia Mediation Process Started.....

Dear Panelist,


The much awaited mediation meeting under the chairmanship of honorable retd. chief justice started today at the mediation center in New Delhi.


As per the news which we got from the officials of the SAOL, Mr. R. C. Lahoti had listened all points carefully and issued further notices to all concerned departments. Advocate Mr. Rajiv from panelists side, Adovocate Mr. Abdi from the Company side and advocates from RBI only were present there. No other department officials were present there. All the advocates of SAOL are satisfied from todays proceedings and outcome of todays meeting. All other departments got notices from Mr. Lahoti.


The meeting is not yet concluded and will be continued for some more sessions in couple of days. As and when we'll get the update of the meeting we'll keep you all posted.

Dear Speakasia....
As everyone know that we all Speak Asians are going through a lengthy legal battle which has come to almost on a conclusive point, we thought of publishing our research on the legal cases and judgement pronounced regarding our business across the world. Since Amway is considered as the mother of all Network marketing companies and also which has fought and won most of the legal cases across world, we have taken it as our case study.


In a 1979 ruling,the Federal Trade Commission (USA) found that Amway does not qualify as a pyramid scheme because distributors were not paid to recruit people and had to sell products to get bonus checks, and the company was committed to buying back its distributors' excess inventory.


In May 2007, the UK Department of Trade and Industry (DTI) accused Amway and distributor organizations Britt World Wide and Network TwentyOne UK of "objectionable practices" and petitioned to wind up the companies. The case against Amway was dismissed in 2008 on the condition that a full earnings disclosure is published publicly, no registration or renewal fees are charged and that the sale of business support materials are prohibited.


Back home in India in September 2006, following a public complaint, Andhra Pradesh state police (CID) initiated raids and seizures against Amway distributors in the state, and submitted a petition against them, claiming the company violated the Prize Chits and Money Circulation Schemes (banning) Act. They shut down all offices of firm Amway. The enforcement said that the business model of the company is illegal. The Reserve Bank of India (RBI) had notified the police that Amway in India may be violating certain laws regarding a "money circulation scheme" .


Following a petition by Amway, the state High Court issued an injunction against the CID and stated the Act did not prima facie apply, however after Amway requested the CID petition be dismissed the High Court declared that if police allegations were true, Amway's Indian subsidiary would be in violation of the act and the investigation should continue. On August 14, 2007, the Supreme Court of India ordered the state police to complete the investigation against Amway in 6 months. In 2008, citing the High Court decision, the Andhra Pradesh state government enacted a ban on Amway media advertisements. Amway challenged the ban and in July 2009 the AP High Court refused a petition the ban should be enforced. As of June, 2009 the original 2006 CID case was still pending at the Chief Metropolitan Magistrate Court in Hyderabad.


On August 6, 2011 Kerala Police sealed the offices of Amway at Kozhikode, Kannur, Kochi, Kottayam, Thrissur, Kollam and Thiruvananthapuram following complaints. The Kerala High Court on 9 November directed the DGP, Kerala Police to file a statement regarding the status of the investigation initiated against the multi-level marketing companies. A Division Bench comprising Acting Chief Justice Manjula Chellur and Justice C N Ramachandran Nair issued the directive while considering a petition challenging the government order regarding the Kerala direct selling regulations.


One of the most important fact which you all would have noticed in the article is that the law across the world is against "Payment of money on recruitment of People in chain". In India it is banned by Prize Chits and Money Circulation Schemes (banning) Act, 1978. Now in case of Speak Asia to restart the business, only thing the learned counsel of the company has to prove in the court of law is, SAOL doesn't pay on recruitment of people. In our view this can be proved without doubt in case of SAOL business model because here "referral is Optional and not Compulsory". Further each and every panelist is paid only for his/her work done.


From the order of the honorable supreme court on 14th Nov, 2011(where a mediator has been appointed for an amicable settlement of issue among parties) it looks like the major victory is almost achieved because in the order there is no mention of SAOL being accused of (1) "distributing quick or easy money" or (2) "Making payment for recruiting people". The court has felt that its a genuine business dispute and should be solved peacefully between the parties concerned. In our opinion it looks like SAOL will definitely be able to restart its business very soon.

What next.
Payments are on the way it is expected to come in 3 weeks ....


As we all know that we have finally hear a one very positive news .And it had came from the house of supreme court this is indeed a victory  in that hearing of 17 October. Honorable Supreme Court had taken an initiative and had passed the order to give relief to the panelist through payout release .To ensure that the payment must go to panelist the Honorable Court had form a committee headed by former chief justice of India .


So now we will discuss all facts an assume at when the payment will come to our account to know 
exact calculation of dates we must analyse what can happen in 3 weeks .

The committee headed by former chief justice of india was given a task to release the payments to 
the panelsit as soon as possible .The question arises will rbi eow and cid and it departments will 
listen to him as quick as they can.The answer is very simple .The committee which has been formed 
is very powerful in itself it has all the constitutional right to take action to ensure the right 
judgement .So there is a great power involved in it so no matter what happen it is for sure that 
payment will come soon.
It may take time to release payments may be 2 weeks minimum and 3 weeks maximum .But 
according to my view the first payment could come very soon. may be 24 october will be the day at 
when we can see the payments .For payments speakasia will have to take permissions from rbi and 
cid and eow and they will give permissions to committee may be in a weak . If they will not do 
immediately then they will have to face the hard words in court .So the final conclusion is that the 
supreme court factor will work here and may be RBI could submit there reply as quickly as they 
can. And the time which was given to eow is expiring at 27 october .So eow can't raise any single 
question against speakasia .So the final conclusion is that payment may come after 24 october 
anytime .With the immidiate effect the committee will take decision soon .So we have won half the 
battle once the payment will release there is not getting back a bright future for speakasia is waiting .

O R D E R


We have heard the learned counsel for the parties.


In our considered view, it is a fit case where a serious attempt should be made for an amicable settlement of the dispute between the parties through the intervention of a learned mediator.


We, accordingly, request Hon'ble Mr. Justice R.C. Lahoti (Former Chief Justice of India) to explore the possibility of an amicable settlement between the parties and submit a report to this Court after the mediation proceedings are concluded.


The learned Mediator would be at liberty to fix his fees/remuneration.


We direct the parties to appear before Hon'ble Mr. Justice R.C. Lahoti on 21st November, 2011 at 11.00 a.m.


List this matter immediately after receiving the report from the learned mediator.


A copy of this order be sent to the learned mediator within two days through a special messenger.

Honourable Justice Mr. Dalbeer Bhandari and Justice Mr. Deepak Mishra has put this matter for mediation and appointed a mediator.

Retd. Justice Mr. Lohati has given responsibility to head the committee and the startup of the payments. Justice Lohati will act as a mediator. The Next hearing is on Nov 21, 2011 at Supreme Court Mediation Center. 

From the very first day of the scandal Speak Asia is committed to pay to his panelists and it has sufficient funds to pay. It is expected that the payments will start from Nov 21 st onwards. Our bank accounts will not starve no longer.

COPS AIM TO MAKE FRAUD FIRM CASE CHARGESHEET WATERTIGHT

EOW had completed their investigation and in november they will filed chargesheet In a news article in times of india .They have published that eow had finished there investigation and soon they will filed a charegesheet soon in november . Is it good for panelist , yes its a great sign in their 90 days of investigati...on they eow just able to find the banking transaction made by speakasia ,and there is no charges against speakasia which proves that speaksia clients were false .

We got one more update that Supreme court petition is postponed, before it was 8th November and now its postponed to 14th November. According to this source next hearing is 14th of November.

SAOL is going start but there is no fixed date for it. 01/Nov/2011..

I understand that these are very testing times and it becomes very difficult to remain calm and patient.  To proceed further maintaining our Unity and dignity is very very important. Definitely SAOL is going start but there is no fixed date for it.  because it is in judical. We should happy that they till with us and fighting for us. Atleast they are trying to do something. Think once what about other company. SpeakAsia is also ready to pay if banks give permisssion. Time has come now to wait with patience and to hear good news. IT IS COMING SOON. Just few days left to regain the GLORY of being SPEAKASIAN. Please pray for Tarak Bajpayee, He is in bed rest and he had been transfer to some high facility hospital for ongoing surgery of heart.
